Conditions Of Sale

These conditions apply to all sales made over the Internet via the depquebec.com website or through the DepQuébec inc. Customer Service.

1. Orders

2. Availability of items

The that we have in stock are generally shipped within 48-72 hours. Items that we do not keep in stock can generally be ordered, and are shipped within a period of two to three weeks. However, DepQuébec cannot be held liable for failing to meet posted delivery times.

3. Price

Prices that are posted on the depquebec.com website are in Canadian dollars, and do not include taxes or delivery charges. The price is payable in full in a single payment at the time when the order is placed. All orders are payable in Canadian dollars.

4. Delivery Charges

Delivery charges include preparation and packaging fees, along with postage. They are determined based on the delivery address, the number of items ordered, and the total value of the order before taxes and delivery charges. Customers cannot combine orders in order to benefit from a reduction in delivery charges under any circumstances.

5. Payment

Orders that are placed via the depquebec.com website must be paid for by credit card. We accept VISA, MASTERCARD, and AMERICAN EXPRESS. Orders that are placed by mail or by telephone may be paid for by money order.

6. Delivery Times

A period of two days must be allowed for processing products that are in stock in our warehouse, and an average of three days must be allowed for a delivery inside Québec. DepQuébec cannot be held liable for a delay in delivery resulting from a shortage of stock or caused by the carrier under any circumstances.

7. Product Returns

Items that are sold by DepQuébec are new and guaranteed to be without defect. If an item is found to be defective, or does not correspond to what was ordered, DepQuébec undertakes to exchange or refund it, including delivery charges, within 10 days following the delivery date, on the condition that it is accompanied by the delivery notice or a copy of the DepQuébec invoice.

Otherwise, sales are final and returns or refund accepted only if the material has arrived broken, damaged, stained or other at destination. The return must be within 10 days of the delivery date.

8. Digital Products

Customers can download digital products purchased on the depquebec.com site as soon as the transaction has been accepted. The number of authorized downloads and number of devices upon which a given digital file may be installed may vary without prior notice.

The digital files acquired are works produced by the authors and are therefore protected by the Copyright Act. Purchasing a digital file is reserved for one store per purchase. Any reproduction, collective use, resale or rent is strictly forbidden and can be subject to legal proceedings.

No exchange, credit or reimbursement can be accepted once a sales transaction of a digital product has been confirmed. In no instance will DepQuébec be held responsible for any compatibility issues between a digital product and an electronic appliance, except in cases when the product description displayed is seen to be invalid.

9. Purchase of the DepConnek package

With the purchase of a package, the customer obtains the right to use the personalized DepConnek website with its own branding with 500 of its products and prices (or more but at an extra cost) for a three month period, hosted by DepConnek.

The client is free to make any desired modifications in compliance with the applicable laws and acceptable standards when it comes to publication on the internet, including respect for image and video copyrights.

DepConnek reserves the right to withdraw a website at any time if the additions made by the client go against any applicable law and/or acceptable publication standards on the internet, without refund.

The site remains the property of DepConnek at all times. The client can acquire it at a cost of $ 10,000 during the first year, an amount that can be indexed each year and increased without notice from year 2. Once purchased, the site becomes the client’s property and as such, can be managed or transferred on a different host or server by anyone chosen by the client and at any time.

If the client opts to pay for an extra domain name (ex: epiceriesoleil.com), this domain name becomes the property of the client and although hosted by DepConnek, it can be transferred on request and at any time to the preferred host of the client.

The three-month period of the package starts from the public launch date of the site. The preparation, programming and other tasks perform prior to the launch is not included in the three-month period.

Once the 3-month package period ends, monthly maintenance fees will be required to keep the site online and to ensure its functionality. The monthly maintenance fees are billed automatically on the 1st of each month to a valid credit card. The client is free to cancel its subscription at any time without any charge or penalty. In case of cancellation, the montly billing ends but no previous payment is reimbursed totally or partly.

Failure to pay these fees will result in withdrawal from the site. If a payment is blocked or not approved, the site is withdrawn after two attempts to contact the customer. The monthly maintenance fees can be raised with 60 days notice.

After purchasing a package, the customer has 5 business days to cancel free of charge. On the 6th day, the sale is considered final and non-refundable.
