IF YOU SELL TOBACCO, YOU CAN BE PROSECUTED, FINED AND SUSPENDED.

Convenience store owners, ask yourselves the following:

If you answered NO, you should know that last year, 5 convenience stores per week were caught selling tobacco to minors, despite the fact that there were 50% less inspections than usual! Imagine this year!

Don’t wait for an offense to fall on you. Put the law on your side by installing the ALERT signage (Assessment of LEgal Responsibility about Tobacco) in your convenience store as soon as possible, offered exclusively by DepQuebec.

How does it work?

The ALERT signage helps to prevent the sale of tobacco to minors while making entrapment efforts more difficult for government mystery-shoppers.

In other words, tobacco buyers are now “legally obliged” to show their IDs but only if you ask them.

Thus, through the ALERT signage, this demand or request is made not verbally, but in writing through in-store signage to all tobacco customers so that it is now up to them to show their IDs and up to you to clear verify them or clear them of this legal obligation should they look over 18 without any possible doubt.

In practice, there is no change for your regular customers once you have cleared them of their legal obligation. Government’s mystery-shoppers, however, will only visit your store once: the legal obligation burden will then be on their shoulders when they visit you. They have no choice but to take the effect of this new provision into account, which could possibly make their approach more easily detectable.

Should they ignore it (by simply trying to buy tobacco like they usually do) without volunteering their ID or admitting firsthand that they don’t have any, it could possibly (without any guarantee) be interpreted by a magistrate as a violation of their legal obligation and contribute to your acquittal. Of course, every case and every magistrate is different, but this new element is sure to muddy the waters in your favor.

So considering these factors, and for a low, non-recurring and risk-free cost, the ALERT signage provides you with the following benefits:

Please note that the ALERT formal notices must be clearly visible. You will want to have not one, but several posters and signs at various strategic locations of your store (doors, checkout, etc.) as well as taking photos once they are installed.

The ALERT signage program takes advantage of the new section 13.1 of the revised Tobacco Act (2015) specifying that, upon request of a retailer or its employee, a tobacco buyer is now “required to prove his age” by showing a government ID card with photo (see more info here).
